  • Citizens Arrest and What Would You Do?

    I found it funny browsing through the Wiki and viewing the laws for different countries regarding a Citizens Arrest.

    Question I'm proposing is what if this happened to you? For example Security guards seem to think they have the same power as a police officer. What would you do if someone tried to pull a Citizens Arrest on you, kind of like on the Andy Griffith show. Would you fight back?

    If they do a citizen's arrest and don't have the right to do one, that's a crime called "false imprisonment". So the lesson is, if you are doing a citizen's arrest, you better be damn sure there's a crime taking place.

    I wouldn't fight if someone tried to do this to me, unless they were using violence. Either they will be proven right or I will and if I am proven right it is them that will be going to jail.

      I can't say I would let someone who wasn't a police officer arrest me. It's just not something I would allow. If someone robbed a gas station that may be different though. Shop owners should have the right to defend their property. Some of the different countries laws on it are fun to read in the Wiki link I gave.

        Not sure what the law over here in the UK is but personally, I would never do a citizens arrest, especially if the crime committed wasn't again me. I'm not getting involved in something that might put me in danger unless it's something really bad (someone kidnapping a kid etc.)

            Hmm, that's public assault, but i won't show myself, I'll simply conduct myself as a gentleman to avoid being disgraced even much. I'll try to find out the reason for this public assault, and sort it wisely.

              I agree , false imprisonment is punishable under law. Legal authorities should take legal actions.

                If you are not a cop or a police officer or any law enforcement officer, there is no way you would be able to force Citizens arrest on me. I'd knock off your teeth before you can do that.

                    If anyone assault me, he or she is definitely getting it back, then we might probably end up in the police station and sort ourselves out.

                      Some people really do more than they are supposed to all because they seek to be recognized or what? If the person isn't stealing or committing any crime, you don't have any need to play the citizen arrest card.

                        I think that's the best place to go, their is no need putting up the fire more even if the opposite number is the one at fault. Police are meant to handle it better, that's exactly where I'll go.

                          It's only criminals that are being driven out by citizens arrest because they are unwanted in the community. But for a law abiding individual who pays his taxes, you can never citizen's arrest him.

                              This can never happen in my country Nigeria. Every one of us here are mad crazy in our own way, so no common security can can pull such arrest on anyone unless it's within their work premises.
